Welcome to Pawtrait Studio, where we transform your pet and human photos into unique, human-like or pet-like portraits using artificial intelligence (AI). By using our service, you acknowledge and agree to be bound by these terms.

Service Description

• Pawtrait Studio employs AI algorithms, including the use of OpenAI's API on Microsoft Azure, to create human-like images from your uploaded pet photos, and pet-like images from your uploaded photos of people. We do not collect, use, disclose, share, or retain any facial data from the photos you upload for biometric analysis.

• The generated images are unique and may vary significantly in style and representation. We cannot guarantee that the results will be consistent for similar inputs.

User Responsibilities

• You must own or have the rights to the photos (both pet and people) you upload. You agree not to use images for which you do not hold the necessary rights.

• You are responsible for the content you upload and the resulting images generated by our AI. This includes understanding that the AI may sometimes produce unintended or unexpected results.

Image Generation and Ownership

• Pawtrait Studio provides the AI-generated images "as is," without manual editing or alteration. The AI, including third-party services like OpenAI's API on Microsoft Azure, may not always function as expected and is subject to limitations and errors.

• Upon creation, the ownership of the AI-generated image is transferred to you. You have the right to use, distribute, and display these images as you see fit, whether for personal or commercial purposes.

• All uploaded images are processed through OpenAI's API on Microsoft Azure and are intended to be immediately deleted from our systems after the generation of the AI-created portraits. Regular audits are conducted to ensure the deletion of any residual data.

Child Privacy (COPPA and GDPR Compliance)

• In compliance with COPPA, Pawtrait Studio does not knowingly collect, use, or disclose personal information from children under the age of 13 without parental consent.

• In compliance with the GDPR, we do not knowingly process personal data of children under the age of 16 (or a lower age if provided for by the laws of the member state) without the consent of the child's parent or guardian.

• If we learn that we have inadvertently collected personal information from a child without proper consent, we will take steps to remove that information from our servers.

• a. Pawtrait Studio and its affiliates are not liable for any direct, indirect, incidental, or consequential damages arising from the use of our service, including but not limited to the performance and functionality of the AI and third-party services like OpenAI's API on Microsoft Azure.

• We endeavor for accuracy but do not guarantee the appropriateness, accuracy, or legal status of the AI-generated images.

We reserve the right to modify these terms at any time. Your continued use of Pawtrait Studio following any changes signifies your acceptance of the new terms.
